These Terms of Use (“Terms”) are a legal agreement between you and Darshan (“we”, “us”, “our”) governing your use of the Coloring Pop application for iPhone and iPad (the “App”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be able to form a binding contract to use the App. If you are a minor in your jurisdiction, you may use the App only with the involvement and consent of a parent or legal guardian.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial use. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works of the App except as permitted by law.
Coloring Pop offers optional auto-renewable subscriptions (“Premium”) that unlock additional pictures, brushes, and features. Current plans include a Weekly and a Yearly subscription; the exact names, prices, and any free-trial length are shown in the App at the time of purchase.
You may cancel a subscription at any time through your Apple ID settings; cancellation takes effect at the end of the current billing period. Purchases are processed by Apple, and refunds are handled by Apple in accordance with the Apple Media Services Terms and Conditions. We generally cannot issue refunds directly for App Store purchases.
Artwork you create in the App belongs to you. Because your creations are stored on your device, you are responsible for backing them up; we are not responsible for content lost due to device changes, uninstalling the App, or errors.
The App and its content—including line-art templates, patterns, graphics, brush engines, logos, and software—are owned by us or our licensors and are protected by intellectual-property laws. Except for the license granted above, no rights are transferred to you.
You agree not to use the App to violate any law, infringe others’ rights, interfere with or disrupt the App, attempt to gain unauthorized access, or misuse the App in any way. We may suspend or terminate access for violations.
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid to us for the App in the 12 months before the claim.
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.
These Terms remain in effect while you use the App. We may suspend or terminate your access at any time if you breach these Terms. Provisions that by their nature should survive termination will survive.
We may modify or discontinue the App or any feature at any time. We may also update these Terms; material changes will be reflected by updating the “Effective date” above. Continued use after changes constitutes acceptance.
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
These Terms are governed by the laws of India, without regard to conflict-of-laws principles, and you agree to the exclusive jurisdiction of the courts located there, except where prohibited by applicable law.
